The subject area is a cleared lot located in the vicinity of Springfield Mall., located between the Monticello Woods subdivision (Thomas Drive) and the and Open Bible Church at 6434 Franconia Road. This area will be subdivided into two R-3 lots, one of which will connect to Franconia Road. The other lot will connect to the Monticello Woods subdivision via a stub at Wayles Street. Substantial construction and other work are proposed in the site plan. The applicant is required to provide an 8-foot wide Type 1 trail along its property frontage. Applicantís request: wave the trail requirement for the following reasons:

  1. A Sidewalk already exists along the frontage.

  2. There is insufficient right-of-way to support an eight-foot wide type 1 trail.

Franconia Road has substantial sidewalk on its North and South sides from the intersection of South Van Dorn Street to Commerce Street. Approximately two miles of these sidewalks were constructed with widths varying from four feet six inches to five feet. In the vicinity of Lee High School, the width jumps to eight feet.

The sidewalk on Franconia Road along the property is a concrete construction four feet eight inches wide, approximately 70 feet long.  The Franconia Road sidewalk is aging,  and is about ten years old. The curb cut is the older variable-plane type, but the segments connecting the sidewalk to the cut are reasonably flat.

This photograph shows the existing sidewalk on the Moreno Property:

Deny the Waiver  for the following reasons:

  1. The segment is short with no substantial barriers in the way.
  2. The existing sidewalk is aging.
